Oliver Mullins, 31, appeared Monday in Wise County Circuit Court as he awaits a May 8 trial date on 50 counts of rape, incest and sexual battery of a minor.
Mullins, who has been suspended from the force without pay, was indicted by a grand jury in June. The indictment said that the sexual assaults had been happening for two years involving the victim who was under the age of 13.
Mullins' attorney was denied a request to call Commonwealth's Attorney Chuck Slemp as a witness in the case in November. They argued that one interview in May was not recorded and that the victim had changed the accusations and her story multiple times.
The former officer was previously convicted on eight counts of sexual battery when he was a teenager, according to court records obtained
A three-day trial is scheduled in the case.
